ScrubChat Terms of Service

This is a template, not legal advice. Have a qualified lawyer in your
jurisdiction review and adapt it before operating commercially. Placeholders in
[SQUARE BRACKETS] must be completed.
1. Agreement
By creating an account you agree to these Terms, the
[Privacy Policy](./PRIVACY_POLICY.md) and the
[Community Guidelines](./COMMUNITY_GUIDELINES.md). We asked you to accept each
separately at signup, on purpose — bundled consent is not consent.
The service is operated by [LEGAL ENTITY NAME], [REGISTERED ADDRESS].
2. Eligibility
You must be 18 or over. ScrubChat is intended for medical students, interns,
residents, doctors and allied health professionals. We may ask you to verify your
role, and we may restrict features until you do.
3. What ScrubChat is — and is not
ScrubChat is an educational and professional discussion platform.
ScrubChat is not:
- a source of medical advice for you or anyone you know
- a substitute for a consultation, examination or investigation
- a telemedicine service
- a healthcare provider, and not a HIPAA-covered entity or business associate
Nothing posted here — by any member, however senior or however verified —
constitutes medical advice or creates a doctor–patient relationship. If you or
someone you know has a medical problem, see a clinician in person.
4. Your account
- Keep your password secret. Use a unique one.
- You are responsible for activity under your account.
- Do not share, sell or transfer your account.
- Do not impersonate anyone or claim credentials you do not hold.
- Tell us immediately at
security@scrubchat.appif you suspect compromise.
5. Your content
You keep ownership of everything you post.
You grant us a worldwide, non-exclusive, royalty-free licence to host, store,
reproduce, adapt (for formats and sizes) and display your content **solely for
the purpose of operating the service**. This licence ends when you delete the
content, except for copies in backups pending routine deletion.
**We do not use your content to train AI models, and we do not licence it to
anyone who does.**
You warrant that:
- you have the right to post it;
- it contains no identifiable patient information;
- it does not infringe anyone's rights;
- it complies with the Community Guidelines.
6. Patient confidentiality
This clause is the reason this platform exists, so it is stated as a term and not
only as a guideline.
You must not post identifiable patient information. You remain bound by your
own professional obligations — the NMC Code of Ethics, GMC Good Medical Practice,
your local council's rules, and any applicable data protection law.
Our technical controls reduce the risk of accidental disclosure. **They do not
transfer your obligations to us, and they are not a guarantee.** If you disclose
patient data here, you have made that disclosure.
Breaching this term may result in immediate account termination and, where a
legal obligation applies, referral to the appropriate authority.
7. Acceptable use
Do not:
- break any law, or facilitate anyone else doing so
- sell controlled substances, forged documents or examination material
- harass, threaten, stalk or dox anyone
- post slurs or dehumanising content targeting a protected characteristic
- post sexual content directed at a person, or any content sexualising a minor
- scrape, crawl or bulk-collect member data
- attempt to bypass rate limits, moderation or access controls
- upload malware, or probe our systems without written authorisation
- create accounts to evade a suspension
Security research is welcome under our
[Security Policy](./SECURITY.md). Good-faith research within that policy will not
be treated as a breach of these Terms.
8. Moderation
We moderate content using automated systems and human reviewers, as described in
the [Moderation Policy](./MODERATION_POLICY.md) and Privacy Policy s.6.
We commit that:
- every automated action is appealable;
- a human decides every appeal — the automated system never reviews its own
decisions;
- the automated system can never permanently ban an account;
- we publish moderation statistics, including our appeal overturn rate.
We may remove content or restrict accounts that breach these Terms or the
Guidelines. Where we can, we tell you what rule applied and how to challenge it.
9. Your rights to leave
You may deactivate (reversible) or permanently close your account at any time
from Settings. Closure has a 30-day grace period, after which your data is
permanently deleted. See Privacy Policy s.8 for the small set of pseudonymous
records that survive, and why.
10. Suspension and termination by us
We may suspend or terminate an account that:
- materially breaches these Terms or the Guidelines;
- poses a risk to patient confidentiality or to other members;
- is operated to evade a prior enforcement action;
- is being used unlawfully.
Except where immediate action is necessary to protect someone, we will tell you
what happened and how to appeal.
11. Disclaimers
The service is provided "as is" and "as available". To the maximum extent
permitted by law we disclaim all warranties, express or implied, including
merchantability, fitness for a particular purpose and non-infringement.
We do not warrant that:
- moderation catches everything (it does not);
- content posted by members is accurate (frequently it will not be);
- the service will be uninterrupted or error-free.
12. Limitation of liability
To the maximum extent permitted by law, our aggregate liability arising from or
relating to the service is limited to the greater of [AMOUNT] or the fees you
paid us in the 12 months before the claim.
We are not liable for indirect, incidental, special, consequential or punitive
damages, or for loss of profits, data, goodwill or professional standing.
**Nothing in these Terms limits liability for death or personal injury caused by
negligence, for fraud, or for anything else that cannot lawfully be limited.**
13. Indemnity
You will indemnify us against claims arising from content you post in breach of
these Terms — in particular, any disclosure of patient information.
14. Changes
We will give notice in-app before material changes take effect. Continued use
after that means acceptance. If you disagree, export your data and close your
account.
15. Governing law and disputes
These Terms are governed by the laws of [JURISDICTION], and the courts of
[CITY] have exclusive jurisdiction, without prejudice to mandatory consumer
protections in your country of residence.
Before litigating, contact grievance@scrubchat.app. Our Grievance Officer
responds within 30 days, and most disputes end there.
